Since your new character has no relations to your old character (the server knows no such thing as family relations), your old character's items are gone. You are not allowed to make a will of any sort that would result in your new character getting your old character's items. Doing so means breaking the golden rule (IC/OOC separation). Does this rule apply to custom items?
i.e. I'm probably going to need to respawn and wish to do it as the son of the character I'm currently playing, the character owened a quill pen and a wedding bracelet as custom itmes, can he not recover those?
It's more that I want to have the option of pusueing reclaiming them, i.e. the son wants his fathers bracelet and quill for memories sake. when I die someone else will get them, not me. I just want to be able to recover them eventually.
A new character receiving assets simply because their predecessor had them is a bad idea. With proper assets you may purchase them [for a believable price, naturally]. That gets muddy with custom items, of course, which is what leads me to think that the admins won't pursue them so fervently. You should take care, however, to avoid making it seem as though your new character has received the items simply because your previous character did.
