Maybe it goes down to wether you were:

1) Fooled into making a mistake. You had the chance to stop it, but didnt. Legal action.

2) Or fooled altogether. You never really had any chance with the available resources. Illegal action.

The core of RPG is, I assume, giving the other side a real chance to roll the dice, even if the chance to win is small, and if you dont, its illegal.

Even then, proving absolutes one way or the other its almost impossible, so you need to see motives, precedents, backgrounds, and history.
